I was delighted to interview Kevin Firth, the Director of the Deposit Protection Service last week where he answered questions, both from me and from listeners.
The DPS runs the only ‘custodial’ tenancy deposit protection scheme where the funds are actually handed over to the scheme to keep safe during the tenancy.
Kevin and I discussed what should be done where there are joint tenants, what landlords need to do if they have forgotten to protect (and why they should take great care NOT to forget!) and the dreaded Superstrike case.

Interesting talk Tessa. I disagree with the point Kevin makes regarding a Lead tenant being transferred to another tenant being a simple process. I’ve had a nightmare with the DPS refusing to transfer the deposit into the name of the second tenant following the Lead tenant leaving after their marriage broke down. I’ve provided all of the evidence requested, including a Surrender of Tenancy document signed by both parties giving their agreement to the deposit being kept in the sole name of the second tenant but this still isn’t sufficient.
